I don't think the hunter would be at fault, even though he may be. He may have shot the deer, but he did not direct that deer into the line of traffic. The deer chose to go that direction on his own. And all motorist should be aware of the possibility of wild game animals entering the highways.
If the hunter were to be blamed, then they would have to be able to blame all land owners who's animals cause vehicle accidents. But then again, the land owner doesn't own the animals, the government does, so why caint the government be sued for vehicle damage and bodily injury caused by one of their animals? This could go on and on with several different scenario's.
IMO, the hunter shouldn't be considered at fault. The animal picked that route to take.......... Good question though.
