Get em!!!
Here's an update on the Flower Lake situation that you guys know I have been trying to gain momentum on the last couple of years. I checked out the lake this past weekend to see what had changed and to check on my Crappie.
The GOOD news - the road that the private folks had pushed up that effectively dammed the lake on the North end has been removed, along with their culvert. We can now get into the Northern most borrow pit, so we have gained back part of our public fishing opportunities. I don't have a way of knowing if all my complaining to the State Lawyer helped in this development but whatever the case that is great news!!
The BAD news - now the private folks have created a bardbed wire fence that runs along the Western boundary of the South Pit and then cuts back and runs almost up to the levee. In what used to be the freely navigable channel that cut through the cypress trees to the main Flower Lake, they have put up a cattle gate. This effectively STOPS ALL PUBLIC ACCESS to Flower Lake.
Trust me, this will not stand. I'm planning to again contact the State Lawyer to provide him this exact update, along with enough pictures that he gets a good idea of what is going on here. My hope is that the powers that be will make a visit to the area, draw the property lines out, define access, eminent domain, whatever is necessary to resolve this once and for all.
If you are reading this and you belong to the club that is restricting this public access, get ready, I have your number! Carry on.
Here is the proof:

Man, I have a DeWalt 36 volt cordless sawzall that'll handle that little gate QUICK.
Mississippi Crappie and Alabama football...Life is good.
How do you get to that lake? I see that it's basically behind Beaver Dam, but have never been to that lake.
Is the barbed wire going across the water to the other side? If you can put a boat in another place and use the water to navigate, they can not keep you from using the water. They may own the land but not the water.
Thanks for fighting the good fight Tracker. Only fished it once, but sure would like to have the option to go back some time in the future and without your efforts, that will never happen.

A lot like the old Wannabe... except with fewer bad words. And Karate chop action. But, yes, still purtier than you.
Crappiholic - you are correct and that is my argument to the State Lawyer. I sent him an email last night. Furthermore, with this gate in place and the property around the lake private, there is now NO PUBLIC EASEMENT to the lake. If I am correct all parties that own property must be allowed some public easement to their property. In this case it is the State of MS that owns the property that is surrounded, but the lawyer has told me that I, as a private citizen, need to file a lawsuit. I told him I have no dog in the fight other than my tax dollars go to the state. In my opinion, it would be TOO EASY for the State to file a lawsuit to gain access to their property asset -- the only question that remains is WHEN is it going to happen. Stay tuned - I'm awaiting a response from the lawyer I'm dealing with.
Thanks,

Thanks for your time and effort. Hope you can get the results desired.
Good luck, Tracker. Us little people have to hang together or else we'll lose our rights to thousands of acres of water in our state simply because we're the little people and presumed stupid.
