    Default Guides and Covid

This is just a heads up for the guides on the board to check their insurance. Mine sent me a notice that they will not pay for anything Covid related. That's a heck of a liability to take on in this day and age. After 19 years guiding and age 67 I've been kicking around retiring but have this year left on my Coast Guard license and really wanted to get 20 years in. There's a lot I will miss if I give it up but there's also a lot of fishing I'd like to do for myself. This lack of coverage might make the decision for me.

Interesting. What would you expect them to cover and what would you be liable for?

Are you thinking a customer could sue you for exposing them? Wouldn't they be required to show gross negligence? If I were a guide I would have a waiver that specifically lists covid and if they don't sign, they don't go on a trip. Simple as that.

Most of the time those waivers ads not worth the paper they are written on.

for a waiver to have validity in a courtroom in this state it helps to have it witnessed and notarized .
but i went thru a lawsuit one time years ago and that particular judge held the "friend of his "
feet to the fire on a note i put on the final check to this particular scheme artist that said "paid in full " in the comment area .
i thought we were done when we walked into court and the judge well hello "Jerry" with a big smile on his face
not sure about legality and or weight some waivers hold in court , but all the guides make you sign one that i have ever been out with none the less .....
i would tend to think a signed "covid clause " waiver would have some decent weight in court though

I would think a signed (and witnessed) waiver would hold water in court, but these days who knows. Sad

I'm not a guide, but I don't see how this is an issue one way or another. Covid is everywhere. No one can make a legitimate claim that any one exposure was the source of it. Any gas pump, restaurant, doctor visit, or family friend could have been the source.

It would be a non-issue in my book. And I certainly wouldn't make any major decisions based on it.

I agree the piece of paper will not stop any lawsuit and a lot expense for anyone to defend themselves no matter if you win or lose.

Still don't see how you could sue for getting Covid from anyone how are you going to prove where it came from. If that was the case there would already be several lawsuits n the works.
