It is a Lady Amherst's Pheasant
Thats it...a Lady Amhurst Pheasant....they are a rare species in one section in England. I have no clue what its doing in the front yard of my house in Lexington, NC. Thanks to everyone for their help. Here is a link to the exact bird I am sure.

according to the link, there are less than 10 pairs left. That thing is rare, and I would contact the local audoban society.
I saw that...then I read where Murray Chicken Hatchery is selling them for $112.00 per pair. They have plenty of them it seems.
its a lady for sure i have 2 and 2 goldens they can cost a good bit
