If a good, original design is being worked on any site members, maybe you should explore patent/trademark registration before sharing or selling your idea. My opinion!

All I can tell you is I have been fishing the Roadrunners since the 1970's. I can't tell you who first made it or anything else, but I can also tell you no one protected it until Blakemore did so in 1994 which their Trademark. It all theirs and I respect their Trademark and their good business decision to do so. I can't speak to anything else because I just don't know and will only say what I know or think to be true.

"G" it's a question that comes up over and over so I personally think it's good to get the truth out there so guys know if they are taking a risk or not. Some just don't believe it, but they can look up that Trademark number and find out or if they can't understand the lawyer talk in it then they can ask and attorney to tell them what is says. I really hate to see someone lose all their hard work and money over not knowing what is real and what is not.

Also guys not realizing what kind of trouble can come from selling pony heads will often post a question like, who sells pony heads because they want some and if someone should reply to that they are just asking for trouble. They need to know it's not a safe practice as they may think it is.

That's the issue I have. If they paid someone for their trademark then great. It makes good business sense to trademark it as well, and I know it gets done with products across the board, from household to car, to tool, etc...but doesn't mean I like it or support it if it wasn't bought, and just took advantage of someone elses good design.

I was thinking of going the road runner route, as Ive never used them, and never had the need as far as I know. The truth about this matter may sway whether I do or don't. I'd love to know the details on how much profit they "saved" by squishing the little guys out tying for a couple shops here and there.

ALSO, could I trademark the ballhead design and have that market cornered if I were to choose, if it's obviously not trademarked?

and "G"....I wish I could go fishing, but wife is finishing grad school, work full time, and have 4 kids....fishing has been a luxury that last few months rather than a hobby or sport.

All I know is I was using Blakemore Roadrunners in the 1970's and they had it then. TTI part was something that changed later I believe, but I really don't know about that. Of course companies join all the time through a buy out or merge. Still Blakemore remains as the company that make Roadrunners!

I have no issue with the company, like I said, I just hope it was their idea or they paid the proper people for their invention.

Well, I left a long reply to this thread and I guess it timed out. Sorry I haven't been on in so long. This time of year means 70-hour weeks instead of 60. Thanks to Skiptomylou for the heads up. Regarding enforcement...We busted four sellers on e-bay just nine-days ago. Another will receive a registered letter this week. Still another seller has violated the trademark a second time and will receive a summons next month. I think it goes without saying, we are protecting our trademark. It breaks my heart to see someone steal from us. Here is the text from the blog that explains our configuration trademark and counterfeiting.

    Our configuration trademark Road Runner

One of my many jobs includes protecting our intellectual property. That means monitoring the on-line auction sites and fishing forums. This also entails walking the aisles of tackle shops, looking for knock-offs.
We are nice at first. The response is usually apologetic and the offenders are often not aware they are breaking the law. Unfortunately, there are those that get ugly about it. Most often, these offenders did not pay federal excise taxes either. Then things get very messy.
Reselling counterfeit products is against the law too. The tackle dealers that carry counterfeit Road Runners are shocked when the local deputy walks in the door. It suddenly becomes a priority to send us the inventory for destruction.
Many anglers think they are getting a “deal” when they purchase counterfeits. You usually get what you pay for though. They may include; over tempered hooks, a steel blade instead of brass and a cheap swivel instead of a stronger, crane swivel.
“But I can’t get them tied with squirrel tail” is not an excuse. We encourage customizing Road Runners. That is one reason we make Road Runner heads available in bulk packaging.
It breaks my heart to see someone steal from us. Stealing intellectual property is a crime. Buyer, beware. Blessings, -TJ
Road Runner lures are protected under the Configuration Trademark #1577913. (The CokeŽ bottle shape is a configuration trademark for example.) “Road Runner” is a registered trademark of TTI-Blakemore Fishing Group.
Thanks Centerliner thanked you for this post

Who invented the roadrunner/pony head? Was it ya'lls design originally?

TreednNC, I was born the same year as the Road Runner was invented so I cannot say I was "there". Burt Hall was the inventor and he passed away just months after we purchased Blakemore. It was a very tough year for his son, Joe. Selling a family business is like selling child. Losing the founder is tougher. Blessings, -TJ

I can imagine it is. I always cringe when I hear about big companies trampling the little guys, mostly the pro/college teams taking up lawsuit against high schools and middle schools over their mascotts, not actual products. I know it's business though. I have no issue with a company that came up with a design or bought rights to it, squishing imposters. I'm glad you cleared the air about the one question I really wanted to know, about it being 'yours' from the get go. Makes me feel 100% better about using/buying your products.

Am I correct to assume purchasing molds and making for one's personal use is OK? Figured if it wasn't, mold production would have been gone years ago.

    Thank you again,
    Justin

Glad to have some support on what I have been saying for years on here. I got lucky and found out about the truth not long after I started tying jigs and every time I see the question come up I try to tell them because someone told me which I feel sure has helped me keep from getting one of the letters as I didn't know anything back then other than I liked them and saw lots of guys selling them. The worst part has been people thinking I am just saying that to keep them out of that part of the market which is so far from the truth. Some of them do get mad when they are told the truth that they are breaking the law and could get into lots of trouble.

Hopefully once and for all this will end the discussion about the truth of guys selling pony heads. So thank you TJ Stallings I do appreciate it!
