    I dont really see the difference between the horseheads and jigs. Other companies were already making jigheads before and you dont see them suing other folks that have started making 'em.:rolleyes:

    The thing you guys are missing is they won! The got the design Trademarked in 1994 and after that the guy that use to make Stump Jumpers for Bass Pro got sued and lots all. They then made the Stump Jumpers for Bass Pro at least until they changed their design and I don't know what happened after that. Trademark is not like a patient that runs out either, it doesn't! The mold you can buy and make them for your self, but not for sales. If anyone thinks they are safe selling pony heads they are sadly mistaken!I think that I still have the emails for that guy that lost all. He contacted me after I unknowingly posted pics of a pony head and told me the story, then I checked it out and it was all true. It took me 2 years to be able to buy the heads and sell Roadrunners under Blakemore's Trademark number. If I sell a Roadrunner with a blade that is not their imprinted blade on it I have to put a sticker on that package saying it was made under their Trademark with the number.

    So anyone how thinks he knows more or that there is a way around this is just kidding his self! I will try and find the emails for the guy that gave me some great advice to not sell pony heads!

    Okay I transferred from my old PC the emails from the guy about this and will copy and paste info here, but will not give out his name since I have not ask him if I could. For all you guys that think there is anything legal you can do I will also post the Trademark number for you so you can check it out for your self.

    My First email from him...
    skip it is my understanding (from personal lawsuit experience) that blakemore lure company has a Trademark on the design of the pony head and no can comercially sell them.

    I sent a reply and mentioned the BPS Stump Jumpers ( I like you didn't believe it then) which he responded to and said this....thanks for the reply.
    thanks for the reply. blakemore makes the bass pro stump jumper for bass pro under license to blakemore as far as do it the trademark excludes the private use of anyone making these for their own use the trademark invoves ANY PONY HEAD that is GENERALLY A
    RIGHT ANGLED HEAD with the eye in the general area of the bend and includes any and all comercial sales of the head to anyone without blakemoe licensing the sale and getting a royalty off each sale. i know because they shut my company down because at the time
    he got the trademark WE were the ones making the bass pro stump jumper and we also were in 5 wal-mart stores here in springfield, mo not trying to tell you what to do just trying to inform you about what and why.


    Last he gave me the Trademark Number...
    skip if it will help you or a lawyer friend look it up the trademark registration number is #1,577,913 and you might even be able to pull it up on the internet

    I will say when I use the Trademark number it doesn't have the comas he had in it so I don't know if that is how you look it up or not.

    You guys take it for what it worth to you, but I can tell you it's not legal to sell pony heads!

    pondhopper the Trademark has nothing to do with the molds or with people making it for their own use. If you still sell them in your store and are pony heads that is a risk you choose to take, but if they ever come down on your store I believe you will sing a different song.

    I am not up on all this legalese but do know a local shop that pours and sells all kinds of jigs was recently sent correspondence from them to cease and decist selling his pony heads and promptly did so. Must have been some pretty convincing stuff cause he won't even discuss it.

    Reminds one of "who came first, the chicken or the egg". Did they actually design the Road Runner/Stump Jumper or did they trademark an original design, then put an honest person out of business? Big companies hijack individual designs and/or small companies efforts more than most would believe. Sound's like more history needs to surface.

    If a good, original design is being worked on any site members, maybe you should explore patent/trademark registration before sharing or selling your idea. My opinion!

    Keith is very talented. A lot of his trademark microspoons and a ton of his soft plastic ideas are being replicated. Many of my jig tying ideas and fishing inventions have been modified and now sell for big bucks by those who could mass produce, patent and trademark them. I could write a book on how my idea of a poor man's fishing bucket with detachable rod holder was stolen from me by a very famous mart store, mass produced in China, and ended up on store shelves. All they did was modify the graphic design on the bucket and "it was a new product."


    That is one of many stories I could tell and why I do not sell my stuff anymore as a business.

    I'd be curious to know how he got his trade mark. If he snatched the trademark out of thin air then he's lost all my respect. If he bought it, then fine, go ahead and be the big bully. It makes the world go around.
