Default Fishing Access

I wasnt familiar with this "Donny" Beaver Jr. character until I read an article in field & stream about him and the surrounding issues about access to waters in pennsylvania. his private club is claiming waters accross the state. The guy is just an *******, nothing else. If you can, pick up a copy of the latest field and stream to read some of his comments. here is a sample.

"They (referring to angry fisherman) could do what I'm doing instead of bitching on the internet. I'd even help show them how to contact landowners and raise money," he says. "access is being lost at an alarming pace. I'm either going to watch it and moan or I'm going to participate."

its just unbelievable

luckily i fish state lakes and i dont have to worry about this, but i feel bad for trout fisherman.

Default Loss of Stream Access

I live in the southern end of Huntingdon county Pa. I have been watching this situation since it started. What you have is a private club with members who have big money and want the little man out. The little man in this case is you and I who pay the taxes all around the Little Juniata river except for their section of stream. What the problem is this kind of situation will have kittens. So far the legal battle has been won by Pa.F & B Comm. which is our only hope and we do have a very fair judge in Huntingdon county. I do not fish for trout myself but everyone around me does in this area. What we need to do is hope, pray and support the organizations who are fighting this battle for us.

I read somewhere that Ohio has been watching what has been going on and found out that he was looking at waters in Ohio and they have started legislation to stop the privatization of public waters. So hopefully other states will follow suit and maybe Pennsylvania can keep this guy at bay but, it seems there are so many loop holes in the laws that a person with money and a very smart lawyer can get what ever they want.
It appears that Hunting and fishing as we knew it will be lost to the little guy unless something is put in place to protect it.

Keep that judge in Huntington, that was a very key ruling for fisherman in the state.

I believe this same guy has some waters in colorado too, its just rediculous. these guys who pay him $90,000+ need their heads checked.

It is the landowners right to post their property private/no tresspassing at thier discretion after all if they have purchased it and paying all of the taxes and or a lease it is thiers wether or not they elect to let people waltz on through is up to them. What needs to be eliminated are all of the frivilious law suits involving property owners held financially liable for someones injuries while fishing or hunting on their land. Look at what happened by Allentown that propery owner was found liable for 10% of monetary damages of that girl that got hit by a stray bullet 1/2 mile away, only because he told the hunter that he could hunt there. The lawsuit was for 1million, you do the math. I have a modest amount of ground and it is all posted, I don't need to worry about someone looking for the big score on my dime. Take a look at this scenario and look at it from their point of veiw what would happen if a group of people were fishing on a creek bank privately owned and the bank collapses someone falls in and drowns, guess what they, most likey, wont own anything after that because some lawyer will find a way to constitute negligence on the landowners part and it will be worth millions of dollars to that individuals family. Even though it was consented by the landowner that the individual could fish there but he was responsible for himself. The legal system is ruining it for all of us-

Just because there is a lawsuit, doesnt mean that it is won. its absurd and i really doubt that it was won. but, its your land and you can do what you like with it
